Ce tapuscrit de l'ordonnance créant la Médaille de la Résistance française ne porte ni date ni numéro. Il s'agit donc certainement du projet d'ordonnance soumis à l'approbation du général de Gaulle. Celui-ci y apporta quelques corrections et ajouts. 

Dans l'article 1er (4e ligne), "dans l'Empire et à l'étranger" remplace "dans l'Empire ou à l'étranger". Le verbe avoir passe du présent au futur simple ("ont contribué" devient "auront contribué"). Le changement le plus important de ce premier article concerne la date de début de reconnaissance des actes de résistance. Le général de Gaulle a remplacé la date du 24 juin, à savoir l'armistice signé entre la France et l'Allemagne, par celle du 18 juin 1940, date de son appel à poursuivre le combat.

C'est l'article 2 qui fait l'objet des modifications les plus importantes.
Au point 2, à la phrase "pris une part effective et importante au ralliement de territoires français à la France Combattante" est ajoutée la mention  "ou rendu des services signalés dans l'effort de guerre de ces territoires". Cet ajout élargit le champ d'application de l'ordonnance aux services rendus et non plus seulement à l'action proprement dite. 

Dans le point 3, le mot "comités" est remplacé par "organisations", "comités" ayant un sens plus restreint en terme d'effectifs et le terme "organisations" faisant plus référence aux mouvements et réseaux actifs en France. La fin de la phrase "dans la propagande destinée à soutenir la Résistance" est remplacée par "dans la propagande destinée à grouper et à soutenir les forces de résistance". Par cette modification, le général de Gaulle montre toute l'importance qu'il accorde à la presse clandestine dans son rôle fédérateur. 

Enfin, le point 5, "rejoint les Forces Françaises libres dans des conditions exceptionnelles de difficultés ou de danger" est reformulée en "rejoint les Forces Françaises Libres dans des conditions particulièrement dangereuses et méritoires". 

Toutes les annotations du général de Gaulle seront prises en compte dans la version finale de l'ordonnance n°42 signée à Londres le 9 février 1943. 

 

Enactment draft introducing the Medal of the Resistance
The annotations were added by General de Gaulle. Media Analysis: This typescript of the enactment that created the Medal of the French Resistance is neither dated nor numbered. It is thus surely a draft of the enactment that still needed the approval of General de Gaulle. The latter added some corrections and supplements.

In the first article (line 4), “in the Empire and abroad” replaced “in the Empire or abroad”. The verb “have” was changed from present to future (“have contributed” became “will have contributed”). The most important modification of this first article concerned the beginning date of the recognition of acts of the resistance. General the Gaulle replaced the date 24 June, the day of the signed armistice between France and Germany, by the date of 18 June 1940, the day of his appeal to continue the fight.

The most important modifications were added to the second article. Under point 2, the sentence “have played an effective and important role in the affiliation of the French territories to the Free French Forces” was complemented with the annotation “or have performed important services, supporting the war effort in these territories”. This annotation extended the field of application of the enactment, so that not only an action itself but also performed services were included.

Under point 3, the word “committees” was replaced by “organizations”, as “committee” has a more limited meaning, referring to professional structures, while “organizations” referred to movements and active networks in France. The end of the sentence “in the propaganda intended to support the Resistance” was replaced by “in the propaganda intended to group and support resistance forces”. With that modification, General de Gaulle expressed the importance of the clandestine press as a unifying institution.

Finally, point 5, “have joined the Free French Forces under conditions of exceptional danger or difficulty” was rephrased in “have joined the Free French Forces under particularly dangerous or meritorious conditions”.

All annotations from General de Gaulle were used in the final version of the enactment number 42, signed in London on 9 February 1943.

Contexte historique

C'est par l'ordonnance n°42, en date du 9 février 1943, que le général de Gaulle, après délibération du Comité National, premier embryon du futur Gouvernement Provisoire de la République française, créait une Médaille de la Résistance Française. Celle-ci était destinée à "reconnaître les actes remarquables de foi et de courage qui, en France, dans l'empire et à l'étranger, auront contribué à la résistance du peuple français contre l'ennemi et contre ses complices depuis le 18 juin 1940".

C'est la seconde, et seule autre décoration créée après l'Ordre de la Libération par le général de Gaulle pendant la guerre. 

Les modalités d'application de l'ordonnance n° 42 ont été fixées par décret n° 774 du 9 février 1943 qui a notamment déterminé les caractéristiques de la décoration.

 

With the order number 42 on 9 February 1943, General de Gaulle created the Medal of the French Resistance, after deliberation of the National Committee, predecessor of the future Gouvernement Provisoire de la République Française (GPRF) (Provisional Government of the French Republic). The aim of this medal was to reward "remarkable acts of faith and of courage that, in France, in the empire and abroad, have contributed to the resistance of the French people against the enemy and against its accomplices since 18 June 1940".

The Medal of the Resistance is the second and only other decoration created, after the Medal of Liberation, by General de Gaulle during the Second World War.

The terms of application of the enactment number 42 were defined by the decree number 774 on 9 February 1943, which has mainly determined the characteristics of the decoration.
