Les principales dispositions des textes législatifs (ordonnance n°42 et décret n° 774 du 9 février 1943) ont été reprises dans cette ordonnance du 7 janvier 1944 du Comité Français de la Libération Nationale. Cette ordonnance sera elle-même modifiée par l'ordonnance n° 45-2855 du 2 novembre 1945.

Cette ordonnance du 7 janvier 1944, signée à Alger, comporte quelques modifications par rapport aux textes de référence de 1943. 
Dans l'article 1, le terme "envahisseur" qui faisait référence principalement aux Allemands est remplacé par l'expression "puissances de l'Axe" qui englobe l'Allemagne, l'Italie et le Japon essentiellement. Par cette modification, les conditions d'attribution s'étendent aux Français libres ayant combattu dans la guerre du Pacifique. Il inclut également la lutte contre l'occupation italienne en France. A la fin de cet article est ajoutée la mention "ou en territoire relevant de la souveraineté française" ce qui élargit également le champ d'application de l'ordonnance de 1943. 

Le point 3 de l'article 1 est reformulé sans que cela ne modifie le sens de la phrase.

Dans le point 5, le mot "libres" de l'expression "Forces françaises libres" est supprimé. En effet, depuis 1943, les Forces françaises libres sont devenues Forces françaises combattantes. 

Enfin l'article 2, relatif au port de la Médaille de la Résistance, est modifié. A compter de cette ordonnance, la Médaille de la Résistance se porte directement après la Croix de guerre et avant la Médaille des évadés. Le décret de 1943 prévoyait son port après la médaille des Evadés. 

 

The main structures of the legislative texts (enactment number 42 and decree number 774 from 9 February 1943) had been adopted in this enactment from 7 January 1944 of the French Committee of the National Liberation. This enactment itself would be modified by the enactment number 45-2855 from 2 November 1945. This enactment from 7 January 1944, signed in Algiers, featured some modifications compared to the texts from 1943.

In the first article, the term “invader” that mainly referred to the Germans, was replaced by the expression “Axis powers” which essentially encompassed Germany, Italy and Japan. With that modification, the terms of awarding were extended and now included the Free French Forces, having fought in the Pacific War, too. It also included the fight against the Italian occupation in France. At the end of the article the mention “or in territories that are relevant for the French sovereignty” was added, which also broadened the field of application of the enactment from 1943.

Point three of the first article was rephrased without changing the sense of the sentence, though.

Under point 5, the word “Free” of the expression “Free French Forces” was omitted. In fact, since 1943, the Forces françaises libres (Free French Forces) had become the Forces françaises combattantes (Fighting French Forces).

Finally, the second article, referring to the placement of the medal, was modified. From the introduction of this enactment on, the Medal of the Resistance was always to be worn directly after the Cross of War and before the Escapees’ Medal. The decree from 1943 determined its placement after the Escapees’ Medal.

Contexte historique

La Médaille de la Résistance française a été instituée, à Londres, par ordonnance du 9 février 1943 du général de Gaulle, " chef de la France combattante ". Son objet était de "reconnaître les actes remarquables de foi et de courage qui, en France, dans l'Empire et à l'étranger, auront contribué à la résistance du peuple français contre l'ennemi et contre ses complices depuis le 18 juin 1940." C'est la seconde, et seule autre décoration créée après l'Ordre de la Libération, pendant la guerre, par le général de Gaulle.

 

The Medal of the French Resistance was established in London, by the enactment from 9 February 1943, by General de Gaulle, “leader of the Fighting French Forces”. His objective was to “reward remarkable acts of faith and of courage that, in France, in the empire and abroad, have contributed to the resistance of the French people against the enemy and against its accomplices since 18 June 1940". The Medal of the Resistance was the second and only other decoration created, after the Medal of Liberation, by General de Gaulle during the Second World War.
